Terms of Service

1. Acceptance of Terms

By accessing or using WhizzFlow (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

WhizzFlow provides a cloud-based platform for mileage tracking, expense management, receipt scanning, fleet operations, accounting, invoicing, and related business operations features. The Service is offered via the web at whizzflow.com and, in the future, through iOS and Android applications. Features may be added, modified, or removed at our discretion.

3. Accounts & Eligibility

You must be at least 16 years old, or the minimum age of digital consent in your country, to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@whizzflow.com if you suspect unauthorized access.

You agree to provide accurate, current, and complete information when creating an account and to keep that information up to date.

4. Cost of the Service

The Service is currently offered at no cost to users. We reserve the right to introduce paid plans, tiers, or premium features in the future. Where such changes apply to features you already use, we will give you reasonable advance notice and, where applicable, the opportunity to export your data or choose not to continue. Nothing in these Terms constitutes a guarantee that the Service will remain free indefinitely.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Upload content that is fraudulent, deceptive, infringing, or violates anyone’s rights.
• Attempt to gain unauthorized access to the Service, other users’ accounts, or related systems.
• Reverse engineer, decompile, or disassemble any part of the Service, except as permitted by law.
• Use the Service to build a competitive product, scrape content at scale, or circumvent usage controls.
• Submit false mileage, receipts, or expense data, including in contexts that could defraud a third party (such as tax authorities or employers).

6. Your Content

You retain ownership of the data you submit to WhizzFlow (trips, receipts, invoices, bank statements, vehicle details, etc.). You grant us a limited, non-exclusive license to store, process, and display your content solely as needed to operate, secure, and improve the Service, and to provide it back to you and your authorized team members.

We do not sell your data. Our handling of personal data is governed by our Privacy Policy.

7. Intellectual Property

The Service, including its software, design, content, branding, and documentation (excluding your own data), is owned by WhizzFlow and its licensors and is protected by copyright, trademark, and other laws. You are granted a limited, non-transferable, revocable license to use the Service for its intended purpose. Nothing in these Terms grants you any right to use our trademarks, logos, or trade dress without prior written consent.

8. Third-Party Services

The Service integrates with third-party providers (including Microsoft Azure, Google Maps, Anthropic Claude, and the European Central Bank). Your use of those services within WhizzFlow may also be subject to their own terms. We are not responsible for the availability, accuracy, or content of third-party services.

9. Service Availability & Changes

We work to provide a reliable Service, but we do not guarantee that it will be uninterrupted, error-free, or continuously available. We may modify, suspend, or discontinue any part of the Service at any time, and we may limit certain features or usage based on reasonable fair-use criteria.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. WhizzFlow is a tool to help you manage data; it is not a substitute for professional tax, legal, accounting, or financial advice. You are responsible for the accuracy of the data you record and for any filings you make based on that data.

11. Limitation of Liability

To the maximum extent permitted by law, WhizzFlow and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. Some jurisdictions do not allow certain limitations of liability, in which case those limitations apply to the extent permitted.

12. Indemnification

You agree to indemnify and hold WhizzFlow harmless from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your content, or your breach of these Terms.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if continued access creates a legal or security risk, or if we discontinue the Service. On termination, your right to use the Service ends immediately. We will give you a reasonable window to export your data except where prohibited by law.

14. Governing Law & Disputes

These Terms are governed by the laws applicable to the entity operating the Service, as identified in the Privacy Policy. Any dispute arising out of or relating to these Terms or the Service will be resolved in the competent courts of that jurisdiction, without prejudice to mandatory consumer-protection rules that may apply in your country of residence.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or in-product message. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
